13(1)(a), 13(2) OF PREVENTION OF CORRUPTION ACT, 1988.

ORAL ORDER

This petition is filed by the petitioner under Section

482 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant and anticipatory bail in Crime No.7 of 2023 of Doddaballapura Town Police Station registered for the offences punishable under Sections 506, 504, 420 read with Section 34 IPC and Sections 13(1)(a), 13(2) of Prevention of Corruption Act, 1988.

2. Heard the learned counsel for the petitioner and the learned High Court Government Pleader for the respondent/State.

3. The learned counsel for the petitioner would contend that, the name of the petitioner is not found in the column of accused in the FIR and the complaint. The accused Nos.1 to 3 named in the FIR have been granted bail. The petitioner has not been arraigned as accused in any of the crimes registered. He has received a notice dated 22.04.2025. He has been granted anticipatory bail in ECIR/BGZO/05/2025 by the Sessions Court by Order dated 27.06.2025, and he has abided by the terms and conditions of the said order. The petitioner is ready to cooperate with the investigation and abide by any terms and conditions to be imposed by this Court. With this, she prays for grant of anticipatory bail.

4. Per contra, learned High Court Government Pleader for the respondent - State would contend that, there is an allegation of transfer of Rs.25,00,000/- to the account of this petitioner. The petitioner has been issued with a notice, and he took time by sending reply, and subsequently has not appeared for investigation. There is an allegation of transfer of Rs.60,00,000/- to the account of the petitioner. The petitioner is required for custodial interrogation. If he is granted anticipatory bail, he will hamper the investigation and tamper the prosecution witnesses. With this, he prayed for rejection of the petition.

5. Having heard the learned counsel, the Court has perused the FIR, complaint and other materials placed on the court.

6. The petitioner has not been arraigned as accused in FIR in Crime No.7 of 2023 of Doddaballapura Town Police Station. The accused Nos.1 to 3 of Crime No.7 of 2023 of Doddaballapura Town Police Station have been granted bail by the Trial Court. There is an allegation that, the petitioner got transferred several amounts to his account by creating some enterprises and frauded the government. The offences alleged against the petitioner are not punishable either with death or imprisonment for life. The petitioner has undertaken to cooperate with the police in investigation. There are no criminal antecedents of the petitioner.

7. Considering all these above aspects, the petitioner has made out a case for grant of anticipatory bail with conditions.
