ORAL ORDER

This petition is filed by the petitioner -accused No.2 under Section 482 of BNSS praying to grant anticipatory bail in Crime No.114/2025 of Kadugodi Police Station registered for offences punishable under Sections 108 and

3(5) of BNS.

2. Heard learned counsel for the petitioner and learned Additional SPP for the respondent -State.

Learned counsel for the petitioner would contend that the allegation against the petitioner is that he has borrowed Rs.2,00,000/- from the deceased and he has not repaid and he was harassing the deceased in repayment of the loan borrowed. He further submitted that accused No.1 who is having similar allegations has been granted anticipatory bail by the Sessions Court. He further submitted that accused No.3 has been granted anticipatory bail by this Court. The petitioner is ready to co-operate with the police in the investigation and abide by terms and conditions to be imposed by this Court. With these, he prays to allow the petition.

4. Per contra, learned Additional SPP for the respondent –State would contend that due to the act of this petitioner and non repayment of loan borrowed, the deceased committed suicide. Investigation is in progress. The petitioner is required for custodial interrogation. With this she prayed for dismissal of the petition.

5. Having heard learned counsels, the Court has perused FIR, complaint and other materials placed on record.

The averments of the complaint indicate that the accused No.1 had borrowed Rs.8,00,000/- and the petitioner -accused No.2 had borrowed Rs.2,00,000/- from the deceased and they have not repaid the amount borrowed. In spite of deceased requesting them to repay the amount borrowed, they were harassing the deceased by non repayment of the amount borrowed. Accused No.1 having similar allegations to that of this petitioner has been granted anticipatory bail by the Sessions Court. Whether the act of this petitioner –accused No.2 that is non payment of amount borrowed amounts abatement to commit suicide is a matter of investigation and trial. The offence alleged against the petitioner is not punishable either with death or imprisonment for life. The petitioner has undertaken to co-operate with the police in the investigation and abide by any conditions to be imposed by this Court. Considering the above aspects, the petitioner has made out case for grant of anticipatory bail with conditions.

7. In the result, the following ORDER i) The petition is allowed.

ii) The petitioner is ordered to be released on bail in the event of his arrest in Crime No.114/2025 of Kadugodi Police Station subject to following conditions;

a) The petitioner –accused No.2 shall voluntarily appear before the Investigating Officer within 10 days from this day and execute a bail bond for sum of Rs.1,00,000/- with one suret
