The petitioner has filed this writ petition seeking a direction in the nature of mandamus to the respondents to effect change of Khata and Pahani in her name in respect of agricultural lands bearing Survey Nos. 31/1 and 32/2 of Haliyuru Village, KasabaHobli, Tarikere Taluk, in terms of the final decree passed in F.D.P. No. 11/2021, and to set aside the endorsement dated 02.09.2023 issued by the Tahsildar (Respondent No. 3) requiring the petitioner to produce an 11-E sketch as a condition for effecting mutation. The petitioner has also challenged the communication dated 27.07.2023 issued by the Assistant Commissioner (Respondent No. 2) to the Tahsildar pointing out certain alleged discrepancies in the petitioner’s application for mutation.
2. Facts of the Case are as under:
The petitioner had instituted a suit for partition and separate possession in O.S. No.76/2016 before the competent Civil Court. The suit came to be decreed on 02.11.2018, declaring the petitioner’s share in the family properties (Annexure-A).
3. The said decree was carried in appeal by the defendants, but both the regular appeals came to be dismissed by judgment and decree dated 16.02.2021 (Annexures B and C), thereby confirming the preliminary decree.
4. Subsequently, the petitioner initiated final decree proceedings in F.D.P. No. 11/2021, wherein the matter was amicably settled and a compromise decree was drawn on 21.08.2021 (Annexure-E), allotting to the petitioner 1 acre 36 guntas in Sy.No. 32/2 and other family members their respective shares.

Pursuant to the said compromise decree, the petitioner submitted a representation before the Tahsildar, Tarikere Taluk, requesting mutation of Khata and Pahani entries in her name in respect of her allotted portion. 6. Upon receipt of the request, the Tahsildar sought the opinion of the Additional Government Pleader, who, upon examination of the decree, recommended that the mutation be effected in terms of the orders passed in F.D.P. No. 11/2021.
7. Acting upon the said opinion, the Tahsildar addressed a letter dated 14.07.2023 to the Assistant Commissioner (Respondent No. 2) recommending approval for change of Khata in accordance with the decree.
