ORAL ORDER

In this petition, petitioner seeks for the following reliefs:-

“ (1) Issue a Writ of Mandamus or any other Writ, or Order and direct respondents No.2 to 4 to consider the representation dated: 02.07.2024 vide Annexure-B without any further delay and (2) Set-aside/quash the notice dated: 16.05.2024 vide Annexure-A bearing No.A4.Anadikrutha Shalay 23/2024-

25/162/23.05.2024.

(3) To pass any such other orders or directions as this Hon’ble Court deems fit to pass in the facts and circumstances of the case in the interest of justice and equity.”

2. On 16.07.2024, the co-ordinate Bench of this Court passed the following interim order:-

“ The respondent authorities have passed Annexure-

A whereby the school being run under the name of Sri Ramakrishna Residential School at Sagara Taluk, Shivamogga District, has been left out from the list of recognized institutions.

It is stated in the said order that as there could be affiliation to one Board of studies, accordingly in light of facts made out, wherein the petitioner institution is seeking affiliation to the CBSE as well as State Board, petitioner has not made out grounds for continuation of recognition.

Learned counsel for petitioner submits that under the name "Sri Ramakrishna Seva Trust", the petitioner institution namely Sri Ramakrishna Residential School as well as another school namely Sri Ramakrishna Vivekananda Residential School (affiliated to CBSE) is being run.

It is submitted that both the schools referred to above have separate infrastructure as required by the appropriate Boards.

It is submitted that insofar as petitioner institution, from 1996 till 2019, renewal of recommendation has been made and reliance is placed on the documents produced along with the memo dated 16.07.2024.

In light of contention raised, if the petitioner is able to demonstrate that both schools under State and CBSE are running in a separate building, having separate infrastructure, the State cannot leave out the name of the petitioner institution.

Learned AGA requests for time file statement of objections.

In the interregnum, there would be stay of Annexure-

A till the next date.

Respondents are at liberty to seek for modification of the interim order upon filing the statement of objections.”

3. Under identical circumstances, this Court disposed of connected W.P.No.24119/2024 vide order dated 20.11.2025 as hereunder:-
