ORAL ORDER

1. The petitioner is before this Court seeking for the following reliefs;

a) Issue a writ of certiorari or any other appropriate writ as this Hon'ble Court may deem fit, quashing and setting aside the impugned notice bearing no: sts/1021/2024 dated 15.10.2025 (at Annexure-A) issued by R-2 quo the petitioner.

b) Pass such other orders as this Hon’ble court may deems fit in the interest of justice and equity.

2. The grievance of the petitioner was that without complying the requirement of Section 26A of the Karnataka Transparency in Public Procurements Act, 1999 [‘KTPP Act’, for short], the petitioner has been debarred from participating in any tenders.

3. Sri.Kiran V.Ron, Additional Advocate General, on instructions, submits that indeed notice had not been issued, but, however seeks liberty to take such steps as are necessary in the matter even if Annexure-A were to be quashed.

4. The debarment proceedings insofar as a tenderer is concerned, being a proceeding which will affect the right to carry out trade and business under Article 19 of the Constitution, it is but required that the principles of natural justice, as also the procedure under Section 26A of the KTPP Act are to be followed in letter and spirit.

5. In the present case, no notice having been issued, no order could have been passed without hearing the petitioner. In that view of the matter, I pass the following:

ORDER i. The writ petition is allowed.

ii. The impugned notice dated 15.10.2025 at Annexure-A issued by respondent No.2 is quashed.

iii. Liberty is reserved to respondents No.1 and 2 to initiate such proceedings as are permissible in accordance with law.

iv. In view of Annexure-A having been quashed, any and further proceedings if initiated in pursuance of Annexure-A would also remain quashed.

v. Pending IAs stand disposed.
