ORAL ORDER

In this petition, the petitioner seeks for the following reliefs;

"a. Issue a writ or order or direction in the nature of certiorari, quash the proceedings of the 192^nd Syndicate (Special) meeting dated 28.11.2024 in No.RGUHSB/RRAC/AUTH(MEET) 23/192SYN/2024 under subject No.192/11(1) in respect of the petitioner college vide Annexure-'F'.

b. Further be pleased to quash the communication/order dated 04.02.2025 in RGU/ADM/BSc(N)/SJES/2023-24 by the respondent No.3 vide Annexure-'F1'.

c. Further be pleased to grant any other relief or reliefs that this Hon'ble Court may be pleased to grant in the facts and circumstances of the case and in the interest of justice and equity."

2. A perusal of the material on record would indicate that

14 students of the petitioner's college along with petitioner approached this Court in W.P.No.11217/2024 against the respondents herein and the said petition was disposed of vide Final Order dated 09.09.2024, which reads as hereunder.

"In this petition, the petitioners seek the following relief:

"Issue a Writ or order or direction in the nature of mandamus, directing the respondents to approve the admissions of the petitioners' students to the S.J.E.S. College for Basic B.Sc. Nursing for the year 2023-24 vide Annexure-

'E'."

2. A perusal of the material on record will indicate that the petitioner Nos.1 to 14 are the students of petitioner No.15 - M/s. S.J.E.S. School of Nursing [College], which is affiliated to the respondent No.2 - Rajiv Gandhi University of Health Science [RGUHS]. The petitioner No.15 - College had got admitted the petitioner Nos.1 to 14 for B. Sc. Nursing for the academic year 2023-24. Apart from the petitioner Nos.1 to 14, the petitioner No.15 - College has also admitted 40 other students.

It is an undisputed fact that the total intake permissible for admission of the students for the petitioner No.15 - College is 60 and the petitioner Nos.1 to 14 come well within the aforesaid upper limit of 60 students as permitted by the respondent No.2 - RGUHS. The material on record also indicates that while the petitioner No.15 - College addressed a Communication dated 05.12.2023 submitting the details of 40 students for approval of admission for the academic year 2023-24, the petitioner No.15 - College did not submit the names of the petitioner Nos.1 to 14 for approval to the respondent No.2 - RGUHS.

4. In this context, it is the specific contention of the petitioner No.15 - College that due to oversight and inadvertence and on account of bonafide reasons, unavoidable circumstances and sufficient cause, the petitioner No.15 - College could not submit the names of the petitioner Nos.1 to 14 for approval of their admission for the acad
