THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO:

I) ISSUE A WRIT OF MANDAMUS OR SUCH OTHER WRIT OR ORDERS OR DIRECTIONS, DIRECTING THE RESPONDENTS TO ISSUE THE ENROLLMENT CERTIFICATE BY ACCEPTING DD OF RS.750/- (RUPEES SEVEN HUNDRED AND FIFTY ONLY) AS HAS BEEN SUBMITTED TO RESPONDENT NO.1.

II) TO DIRECT THE RESPONDENT NOS. 2 TO ISSUE COP.

III) TO AWARD COSTS AND GRANT SUCH OTHER RELIEF(S) AS THIS HON’BLE COURT DEEMS FIT AND EXPEDIENT IN THE CIRCUMSTANCES OF THE CASE, IN THE INTERESTS OF JUSTICE AND EQUITY.

ORAL ORDER

1. The petitioner is before this Court seeking the following prayer:

a. “Issue a writ of mandamus or such other writ or orders or directions, directing the respondents to issue the enrollment certificate by accepting DD of Rs.750/- (rupees Seven Hundred and Fifty Only) as has been submitted to Respondent No.1.

b. To direct the Respondent Nos. 2 to issue CoP.

c. To award costs and grant such other relief(s) as this Hon’ble court deems fit and expedient in the circumstances of the case, in the interests of justice and equity.”

2. Learned counsel for the petitioner submits that the excess amount being collected by the Bar Council should not be collected, as it runs contrary to the judgment of the Hon’ble Apex Court in the case of GAURAV KUMAR Vs. UNION OF INDIA, (2025) 1 SCC 641

3. Smt. Archana Magadum, learned counsel appearing for the State Bar Council, submits that after the contempt proceedings were initiated and an order was passed by the Hon’ble Apex Court in the said contempt petition, the Bar Council is not collecting any amount in excess of what is statutorily permitted.

4. In light of the aforesaid submissions, the petition does not survive for any further consideration and is, accordingly, disposed of.
