ORAL ORDER

(PER: THE HON'BLE MR. JUSTICE S G PANDIT)

This appeal by the appellant/husband filed under Section 19(1) of the Family Courts Act, 1984 is directed against judgment dated 8.4.2022 passed in MC No.9/2022 on the file of the learned Principal Judge, Family Court, Bagalakote, whereby the appellant’s petition filed under Section 13(1)(i-a) of the Hindu Marriage Act, 1955 is dismissed.

2. Today, learned counsel Sri.M.C.Hukkeri for the appellant files a memo signed by the appellant praying to dismiss the appeal as withdrawn. The memo reads as follows:

“That, the appellant herein has filed this M.F.A. being aggrieved by the M.C.No.9/2022 passed by the Pril Judge Family Court Bagalkot dated 08/04/2022. This Hon'ble court issued notice to the respondent. Now the both appellant and respondent have filed M.C. No.16/2023 under section 13[B] on the file of Pril. Senior Civil Judge & JMFC Hosapete, wherein both parties have filed memorandum of settlement on 24/03/2023, accordingly the Hon'ble court accept the memorandum of settlement and passed order on 13/04/2023 by dissolving the marriage between and respondent solemnized petitioner 08/01/2021. The certified copy of order is produced herewith for kind perusal of this Hon'ble court. Hence the appellant requests this Hon'ble court may pleas to dismiss this petition as withdrawn in the interest of justice.”

3. A reading of the above memo indicates that the appellant and respondent have arrived at settlement and their marriage is dissolved by decree of divorce in MC No.16/2023 on the file of learned Prl. Senior Civil Judge and JMFC, Hosapete. The memo is placed on record. The appeal stands dismissed as withdrawn.
