ORAL ORDER

This petition is filed by the petitioner –accused No.1 under Section 483 of BNSS seeking grant of bail in C.C.No.15885/2025 pending on the file of the VII Additional Chief Judicial Magistrate, Bengaluru City registered for the offence punishable under Section 311 of BNS.

2. Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent –

State.

3. Learned counsel for the petitioner would contend that FIR has been registered against unknown persons. There is no recovery of any robbed articles from this petitioner – accused No.1. Dagger and cash has been recovered from accused No.2 and he has been granted bail by the Sessions Court. The petitioner –accused No.1 is similarly placed to that of accused No.2 who has been granted bail by the Sessions Court. Therefore, this petitioner –accused No.1 is entitled to grant of bail on the ground of parity. With these, he prays to allow the petition and grant bail to the petitioner –accused No.1.

4. Learned High Court Government Pleader for the respondent –State would contend that serious overtacts are alleged against the petitioner –accused No.1. Therefore, the petitioner –accused No.1 is not entitled for grant of bail on the ground of parity. She further submits that there are no criminal antecedents as per report of concerned police station. With these, she prays for dismissal of the petition.

5. Having heard learned counsels, this Court has perused charge sheet records and other materials placed on record.

6. The case has been registered in Crime No.487/2024 of Vidyaranyapura police station against unknown persons for offence punishable under Section 311 of BNS. The police after investigation have filed charge sheet against petitioner –accused No.1 and accused No.2 for offence punishable under Section 311 of BNS. The petitioner –accused No.1 came to be arrested on 23.03.2025 and he is in judicial custody. There is recovery of dagger –knife and cash from accused No.2. Certified copy of order sheet is produced, it shows that accused No.2 has been granted bail by the Sessions Court. The petitioner –accused No.1 is similarly placed to that of accused No.2 who has been granted bail. As charge sheet is filed, the petitioner –accused No.1 is not required for custodial interrogation. Considering all these aspects, the petitioner –accused No.1 has made out grounds for grant of bail with conditions.

7. In the result, the following ORDER i) The petition is allowed.

ii) The petitioner –accused No.1 is granted bail in crime No.487/2024 of Vidyaranyapura police station pending in C.C.No.15885/2025 on the file of VII Additional Chief Judicial Magistrate, Bengaluru subject to following conditions a. The petitioner –accused No.1 shall execute a personal bond for a sum of Rs.1,00,000/- (rupees one lakh only) with one surety for the likesum to the satisfaction of the trial Court.

b. The petitioner –accused No.1 shall not
