Facts of the case:
An establishment contested its liability to be covered under the state social security legislation. Following a final judicial pronouncement by the apex court confirming its coverage, the regulatory authority initiated proceedings to recover outstanding contributions and interest based on previously determined orders. The lower insurance court granted partial relief, modifying the contribution amounts and waiving a significant portion of the interest, citing the prolonged pendency of litigation. The regulatory body challenged these orders, asserting that the applications were time-barred and that the tribunal lacked the power to waive mandatory statutory interest.

Findings of Court:
The court held that the cause of action for challenging a determination of contribution arises upon the issuance of the order under Section 45A, not from the subsequent recovery notice. Furthermore, the court determined that interest is a mandatory statutory liability that cannot be waived by an insurance tribunal in the absence of an explicit stay regarding the coverage or the determination itself. However, the tribunal retains the authority to verify the factual correctness of the contribution quantum based on the provided evidence.

Issues: The central issues addressed were whether claims challenging contribution assessments were governed by a specific limitation period, the legality of waiving statutory interest during litigation, and the extent of the tribunal's authority to modify the calculation of contributions.

Ratio Decidendi: The statutory limitation for challenging an assessment order commences strictly from the date of the determination order under Section 45A. Interest on unpaid contributions is a statutory obligation arising from the delay in remittance; therefore, a tribunal has no jurisdiction to waive such interest unless there was an explicit order staying the validity of the coverage or the underlying demand at the relevant time.

Result: Appeals allowed in part; the waiver of interest was vacated, and the applications for most cases were dismissed as time-barred.
