Learned Additional Government Advocate accepts notice for respondent No.1.
2. Sri P.V. Chandrashekar, learned counsel is directed to accept notice for respondent Nos.2 to 5.
3. The petitioner has approached this Court seeking a writ of mandamus directing respondent No.4 to reconsider the award amount and re-determine the compensation strictly on basis of the square feet rate applicable to residential properties, instead of assessing it under agricultural standards.
4. Heard learned counsel for the petitioner, learned AGA for respondent No.1 and learned counsel for respondent Nos.2 to 5.
5. The land belonging to the petitioner bearing Sy.No.39/6, measuring 3 acres 23 guntas, situated at Gowdasandra Village, Kasaba Hobli, Gouribidanur Taluk was acquired by the State in exercise of powers conferred under Section 28(1) of the Karnataka Industrial Area Development Act, 1966 (‘KIAD Act’ for short), for the purpose of industrial development. A preliminary notification was issued on 24.08.2020 followed by final notification dated 19.08.2022. The petitioner has submitted the representations at Annexures-N and Q requesting determination of the compensation on a square feet basis.
6. The Land Acquisition Officer issued notice, calling upon the landowners including the petitioners to receive the tentative compensation amount, which was fixed at `15,00,000/-. The material on record indicates that no final award has been passed by the respondents- authority. The petitioner's representation requesting determination of compensation on the square feet basis have not yet been considered or rejected by the authority. Therefore, the writ petition is premature, and the relief sought by way of mandamus is unsustainable in law.
