ORAL ORDER
Petitioner is seeking to quash the entire proceedings arising out of a case registered in Crime No.5/2024 of HAL Police Station, for the offence punishable under Section
506, 364(A), 504, 323, 324 r/w 34 of IPC.
2. The contention of the learned counsel for petitioner that certain amount was received by one Aslam and the said amount was paid to him and there is delay in lodging the complaint and therefore, the entire allegations against the petitioner alleging kidnap etc., is false, cannot be accepted at this stage. As per the complaint averments, on 30.12.2023 at about 8.00 p.m., three unknown persons have forcefully took the complainant in a Innova Car, abused and assaulted him and transferred certain amount by obtaining his account details. It is also alleged that they have threatened the complainant with dire consequences that he will be killed if any complaint was lodged to the Police.
3. The investigation is under progress. The statutory duty of the Police to conduct investigation and to file an appropriate report cannot be inferred with. This Court cannot conduct a mini trial and examine the complaint allegations and quash the entire proceedings, when there are serious allegations made in the complaint. Petitioner has been named as an accused in the FIR. If any chargesheet is filed, it is always open for the petitioner to challenge the same. The Police are also directed to conclude the investigation and file an appropriate report expeditiously.
Petition is dismissed.
