ORAL JUDGMENT

This writ appeal filed under Section 4 of the Karnataka High Court Act, 1961 by the respondents before the learned Single Judge, is directed against order dated 12.06.2024 in WP No.101033/2024, whereunder the learned Single Judge passed the following order:

i) The petition is allowed.

ii) The writ of mandamus is issued to respondents No.2 and 3 to consider the representation dated 25.07.2023 and enter the names of the petitioners in the record of rights based on the registered sale deed with respect to RS No.163(1) the same shall be done within an outer limit of four weeks from the date of receipt of copy of the order.

2. Heard the learned AGA for the appellants/State Authorities and learned counsel Smt. Soubhagya Vakkund for the respondents. Perused the entire writ appeal papers.

3. The State Authorities are in appeal against the direction of the learned Single Judge directing the appellants to consider the representation dated 25.07.2023 and enter the name of the petitioners in the RTC based on the registered sale deed with respect to RS No.163/1, only on the ground that the proceedings under Form-7A of the Karnataka Land Reforms Act, 1961 is pending before the Land Tribunal. On the said ground, the authorities cannot refuse to enter the name of the purchaser. However, it is made clear that entering the name of the petitioners in the RTC in respect of land in RS No.163/1 would be subject to outcome of the proceedings pending before the Land Tribunal in Form-7A of the Karnataka Land Reforms Act, 1961.

4. With the above observation, the writ appeal stands disposed of.
