ORAL ORDER

The proceedings in C.C.No.6970/2021 on the file of the Court of 8^th ACMM, now pending before the 41^st ACMM, Bengaluru are sought to be quashed in this petition.

2. Charge sheet is filed against the petitioner for the offence punishable under Sections – 406, 420, 504 and 506 of IPC.

3. A joint application seeking permission of the Court to compound the offence is filed under Section – 320 read with Section-482 of Cr.P.C. The application is accompanied with the consent terms entered between the parties namely, the petitioner and respondent No.2 / defacto complainant. Para-9 of the consent terms is extracted herein:

“9. It is mutually agreed between the parties that the Party of the First Part shall further pay to the Party of the Secord Part a total sum of INR Rs.5,71,00,000/- (Rupees Five Crores Seventy One Lakh Only) (hereinafter referred to as the “Settlement Amount”) in consideration whereof all previous and outstanding dues, claims and liabilities, whether monetary or otherwise, stand fully discharged and repaid, and the party of the Second Part shall have no subsisting claim in respect thereof.”

4. The mode of payment has been stated at para –

11 of the consent terms. The application along with the consent terms are placed on record.

5. It is stated that the parties were engaged in certain business dealings and commercial engagements with one another and in the course of such dealings, certain commercials disputes, differences arose. In view of the settlement, the second respondent / defacto complainant has agreed to extend full, unconditional and continuing cooperation in securing the quashing of the proceedings now pending against the petitioner. It is also stated that by virtue of the settlement, no grievance, dispute, claim or cause of action of any nature what so ever survives between them.

7. Having perused the charge-sheet material this Court is convinced that the dispute is purely private, which is commercial in nature and the offences are compoundable. In view of the settlement, the ends of the justice would be secured by permitting the parties to compound the offence to bring quietus to the entire dispute.

8. Accordingly the following:

ORDER i. Petition is allowed.

ii. The entire proceedings in C.C.No.6970/2021 on the file of the Court of 8^th ACMM, now pending before the 41^st ACMM, Bengaluru for the offence under Sections – 406, 420, 504 and 506 of IPC are quashed.

iii. Consequent to the quashing of the proceedings, the issuance of summons / warrant through Embassy, Look Out Circular as well as the Red Co
