ORAL ORDER

The petitioner is challenging the complaint, order taking cognizance and issuance of summons in C.C.No.39176/2022 on the file of the XXXIX Additional CMM Court, Nrupathunga Road, Bengaluru.

2. Complaint is filed by the respondent herein alleging offences punishable under Section 499 and 500 of IPC. The learned counsel for respondent has filed a memo, which reads as under:

“The Counsel for the respondent most respectfully submits as follows:

It is submitted that a compromise has been arrived at between the Petitioner and the respondent in the above – captioned proceedings.

It is further submitted that, pursuant to the said compromise, the respondent has undertaken to withdraw the proceedings pending before the Additional Chief Judicial Magistrate Bengaluru City in C.C.No.39176/2022 (Santhosh Menon v. Joseph Hoover).

It is submitted that the respondent has agreed to take necessary steps for withdrawal of the said proceedings before the Learned Trial Court, through his Counsel, in accordance with law.

It is brought to the Notice of this Hon’ble court that the next date of hearing in the said proceedings before the Learned Trial Court is 31.12.2025.

This memo is filed for the limited purpose of placing the above facts and the undertaking of the respondent on record before this Hon’ble Court.”

3. Learned counsel submits that a compromise has been entered between the parties and the respondent / complainant has undertaken to withdraw the proceedings pending before the trial Court.

4. In view of the memo and the undertaking given by the respondent / complainant to withdraw the complaint, no purpose will be served in keeping the petition pending.

5. If the complaint is not withdrawn, it is open for the petitioner to challenge the proceedings.

6. With the above observations, the petition is disposed of.
