ORAL ORDER

This petition is filed by accused Nos.1 to 5 under Section 482 of BNSS praying to grant anticipatory bail in respect of Crime No.228/2025 of Srirangapatna Police Station registered for offences punishable under Sections 189(2), 191(3), 352, 126(2), 118(1), 115(2) and 190 of BNS.

2. Heard learned counsel for petitioners and learned High Court Government Pleader for the respondent -State.

3. Learned counsel for petitioners would contend that in suit filed by petitioner Nos.2 and 3 in O.S.No.60/2022 2022 there was compromise recorded and compromise decree has been drawn and survey No.345 has been allotted to petitioner No.2. When surveyor came to the spot to measure the said property, there was a quarrel among the petitioners and injured and others. In the said quarrel both side have sustained injuries. Petitioner No.3 has filed complaint and it is registered in Crime No.227/2025. The complaint filed against petitioners has been registered in Crime No.228/2025. There is a case and counter case. The petitioners are ready to co-operate with the Investigating Officer in the investigation and abide by any terms and conditions to be imposed by this Court. The offences alleged against petitioners are not punishable either with death or imprisonment for life. There are no criminal antecedents of the petitioners. With this, he prayed to allow the petition.

4. Per contra, learned High Court Government Pleader for the respondent –State would contend that the complainant has sustained three injuries. Out of them, one injury is grievous injury and assault is attributed to accused No.1. The another injured -Appaji Gowda has sustained simple injuries. Investigation is in progress. With this, she prayed to reject the petition.

5. Having heard learned counsels, the Court has perused the FIR, complaint and other materials placed on record.

6. There was a quarrel between petitioners, the injured and others on 08.10.2025 when surveyor came to the spot to measure the property as per compromise decree. In the said quarrel, both side parties sustained injuries. Petitioner No.3 filed complaint. The injured has also filed complaint and it is registered in Crime No.228/2025. The date and time of incident in both the crimes are the same. C
