ORAL ORDER

This petition is filed by Accused No.3 under Section

483 of BNSS praying to grant bail in Cr.No.334/2025 of Yelahanka Police Station registered for offences under Section 309(4), 310(2), 61(2) read with 3(5) of BNS. 2. Heard learned counsel for the petitioner and learned HCGP for respondent/State.

3. Learned counsel for the petitioner would contend that the names of accused persons are not stated in the FIR. The FIR is registered against unknown persons. The petitioner is not having any role in the case. The petitioner only has taken his Omni car as per instructions of accused No.1 and carried them to the spot and thereafter carried them and for that he had received Rs.2,00,000/- from accused No.1. There is a recovery of Rs.1,50,000/- from the petitioner. The petitioner is in judicial custody since 23.09.2025. The petitioner is not having any criminal antecedents. With this he prayed to allow the petition. 4. Per contra, learned HCGP would contend that there is a robbery of Rs.1,50,00,000/- cash and 50 grams of gold ornament from the house of complainant. The accused persons came in Maruthi Omni car of this petitioner and committed robbery in the house of complainant. The petitioner was driving the said Maruthi Omni car at the time of the incident. Investigation is in progress. Accused No.8 is absconding and he has to be secured. With this, he prayed to reject the petition.

5. Having heard the learned counsel, the Court has perused FIR, complaint and other materials placed on record.

6. There is a robbery of Rs.1,50,00,000/- cash and

50 grams of gold ornaments and documents from the house of the complainant on 19.09.2025. Some unknown persons entered the house of the complainant stating that they are from Government Department and they searched in the house of the complainant and found cash of Rs.1,50,00,000/- and 50 gram gold ornament and took them and went away in Maruthi Omni car. The petitioner is stated to be driving the Maruthi Omni car at that time. On reading the volunteer statement of the petitioner/accused No.3, he was not aware of any robbery by the other accused in the house of complainant. The petitioner only carried the accused persons in his Maruthi Omni Car to the spot and thereafter took them and dropped them to some place for which he received Rs.2,00,000/-. Rs.1,50,000/- has been recovered from the house of this petitioner. The petitioner is in custody since 23.09.2025. As major portion of investigation is over, he is not required for further custodial interrogation. There are no criminal antecedents of the petitioner. Considering the above aspects, the petitioner has made out case for grant of bail with conditions. In the result, the following:

ORDER The petition is allowed. The petitioner is granted bail in Crime No.334/2025 of Yelahanka Police Station, subject to following conditions:
