16/2025 IN THE R-1 POLICE STATION.

ORAL ORDER

1. The Petitioner is before this Court seeking for the following reliefs:

a) To quash Annexure-A-the impugned requesting communication letter written by the 1st Respondent to the 2nd Respondent on 17.02.2025 bearing letter No.CR-15/2025, stating that, the petitioner should not alienate the property in document No.BMH-1- 09006/2022-23 dated 13.12.2022 Execution on 09.12.2022 vide Annexure-K till the completion of enquiry in crime No.15 & 16/2025 in the 1st respondent police station.

b) And pass such any other order deems fit under facts and circumstances of the case, in the interest of justice.

The grievance of the Petitioner is that Respondent No.1 vide impugned communication letter/order dated 17.02.2025 at Annexure-A had directed Respondent No.2-Sub-Registrar not to register the transfer of the property belonging to Petitioner covered under document bearing No.BMH-1-09006/2022-23 dated 13.12.2022.

3. The contention of learned counsel for the Petitioner is that there is no power in the respondent police to issue/give any such direction to the Sub-Registrar to restrain transfer of any conveyance. In fact, in the order at Annexure-A, no provision as regards under which rights and powers have been exercised has been mentioned.

4. Notice having been issued. Respondents have entered appearance.

5. Sri. T. N. Vishwanath, learned counsel for Respondent Nos.3 and 4 would submit that Respondent Nos.3 and 4 have been cheated by the Petitioner. A property which did not belong to the petitioner has been sold by the petitioner and her accomplices including her brother and it is for that reason that the property which has been purchased from the proceeds of the crime arising out of the cheating committed by the Petitioner and her accomplices on Respondent Nos.3 and 4 have been seized by Respondent No.1 in order to protect the interest of Respondent Nos.3 and 4 and on that ground, he submits that this Court ought not to intercede with the matter.

6. The submission of Sri T. N. Vishwanath, learned counsel, proceeds on the premise that the impugned action of Respondent No. 1 was motivated by an intention to protect the interests of
