IN THE HIGH COURT OF KARNATAKA AT BENGALURU
Shivashankar Amarannavar, J
RAVI M – Appellant
Versus
THE STATE OF KARNATAKA – Respondent
CRIMINAL PETITION No. 16212 OF 2025
For the Appellants/Petitioners: Pratheep K.C
For the Respondents: Channappa Erappa
Bail may be granted in cases involving minors where the victim's statement indicates a consensual relationship and marriage, the investigation is complete (charge sheet filed), and the accused has no criminal antecedents.
Headnote:The case involves allegations under Sections 137(2) and 64 of the Bharatiya Nyaya Sanhita, 2023, Sections 5(j), 5(l), and 6 of the POCSO Act 2012, and Section 9 of the Prohibition of Child Marriage Act. The petitioner was accused of enticing a minor girl, marrying her, and engaging in sexual intercourse which resulted in pregnancy. The court noted that the victim's statement recorded under Section 183 of the BNSS indicated a consensual love affair and marriage, suggesting an absence of force or coercion. The primary issue was whether the petitioner was entitled to bail given the nature of the charges. The court reasoned that since the victim's own statement supports the claim of a consensual relationship and marriage, and because the charge sheet has already been filed, custodial interrogation is no longer required. The court further observed that the victim was nearly 16 years old and capable of understanding the consequences of her actions, and the petitioner had no criminal antecedents. Petition is allowed.
