ORAL ORDER

This petition is filed to quash the charge sheet and

entire proceedings pending before the learned Judicial

Magistrate, First Class at Devadurga in C.C. No.39/2021 for

the offences punishable under Sections 143, 147, 341, 269,

270 read with Section 149 of Indian Penal Code.

2. Learned counsel for the petitioner would submit

that the issue raised in the present petition is covered in

terms of the judgment of the Co-ordinate Bench in Crl. P.

No.102902/2023 C/w Crl.P. No.102904/2023.

3. Learned High Court Government Pleader would

fairly submit that the issue raised in the present petition is

covered in terms of the aforementioned judgment.

4. This Court has perused the contents of the

complaint. It is noticed that the case is filed against the

petitioner on the premise that the petitioner has not followed

the protocol during the Covid-19 pandemic.

5. Considering the aforementioned complaint and

the aforementioned judgment, the Court is of the view that

the issue raised in the present petition is squarely covered in

terms of the judgment in Crl.P. No.102902/2023 C/w Crl.P.

No.102904/2023. Hence, the following:

ORDER

(i) Petition is allowed.

(ii) The proceeding before the learned Judicial

Magistrate, First Class at Devadurga in C.C. No.39/2021 for

the offences punishable under Sections 143, 147, 341, 269,

270 read with Section 149 of Indian Penal Code is

quashed.
