THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT, ORDER OR DIRECTION IN THE NATURE OF MANDAMUS DIRECTING THE RESPONDENT NO.1 TO CONSIDER THE REPRESENTATION DATED 08.04.2025, VIDE ANNEXURE-C AND PASS APPROPRIATE ORDERS IN THE INTEREST OF JUSTICE AND EQUITY AND ETC., THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
ORAL ORDER
(PER: THE HON'BLE MR. JUSTICE M.NAGAPRASANNA)
1. The petitioner is before this Court seeking the following prayer:
a. “ISSUE a Writ, Order or direction in the nature of mandamus directing the respondent No.1 to consider the representation dated 08.04.2025, vide Annexure-C and pass appropriate orders in the interest of justice and equity.
b. ISSUE a Writ, order Or direction in the nature of mandamus directing the respondent No.2 to consider the representation dated 08.04.2025, vide Annexure-C1 and pass appropriate orders in the interest of justice and equity.
c. ISSUE such other Order or direction that is deemed fit under the facts and circumstances of the case in the interest of justice and equity.”
2. It is stated that the respondent-Corporation issued a notification calling for online applications for allotment of a petrol pump dealership on the stretch of Navali on State Highway-
No.63.
3. In response to the said notification, the petitioner submitted his application along with all requisite documents. The petitioner is before this Court on the grievance that his application has not been considered and that such non-
consideration may result in adverse consequences.
4. It is further stated that the petroleum outlet has been allotted to another candidate, which, according to the petitioner, is contrary to law. However, the said allotment is not challenged before this Court. The petitioner has only submitted a representation to the respondents seeking consideration of his case.
5. In view of the prayer being innocuous, this Court deems it appropriate to dispose of the petition with a direction to the respondents to consider the representation submitted by the petitioner and pass appropriate orders thereon within an outer limit of twelve (12) weeks from the date of receipt of a copy of this order.
6. It is made clear that this Court has not examined the merits of the petitioner’s claim for allotment. The direction issued is only to consider the representation and pass orders in accordance with law. Ordered accordingly.
