Heard Sri. V. Shivareddy, learned Additional Government Advocate for the petitioner-State.
2. Respondent No.1 was before the Tribunal in Application No.434/2025 questioning the enquiry report dated 06.12.2022 as well as order of penalty dated 25.10.2024 (Annexure-A12) imposing punishment of withholding 30% of pension under Rule 214(1)(a) of the Karnataka Civil Services Rules, 1958 (KCSR). The Tribunal under impugned order dated 17.04.2025 in Application No.434/2025 allowed the application and set aside the impugned order.
3. The said order dated 17.04.2025 in Application No.434/2025 was the subject matter of Writ Petition No.29036/2025 filed by Karnataka Lokayukta-respondent No.2 herein. This Court by Order dated 09.10.2025, dismissed the writ petition holding that there is no infirmity in the findings of the Tribunal. The said order was passed after hearing learned counsel for Lokayuktha as well as learned Additional Government Advocate for the Government.
4. Since the impugned order herein is affirmed by this Court by order dated 09.10.2025 in Writ Petition No.29036/2025, the present writ petition also stands dismissed in terms of the order dated 09.10.2025 in Writ Petition No.29036/2025.
