ORAL ORDER

This petition is filed by accused No.1 under Section

482 of BNSS praying to grant anticipatory bail in Crime No.71/2025 of Ijoor Police Station, registered for offences under Section 192(A), 177 of the Indian Motor Vehicles Act, 1989, Section 11(1)(a) of the Prevention of Cruelty to Animals Act, 1960, Sections 5, 4 of the Karnataka Prevention of Slaughter and Preservation of Cattle Act, 2020, Section 97 of the Transportation Animals Act, 1978, Sections 7, 12 of the Karnataka Prevention of Slaughter and Preservation of Cattle Act, 2020 and Section 325 of the Bharatiya Nyaya Sanhita, 2023.

2. Heard learned counsel for petitioner and learned Additional SPP for respondent/State.

3. Learned counsel for petitioner would contend that the petitioner has purchased cows in Hassan and he was transporting them to his place and he purchased the same for agriculture purpose and not for cow slaughtering. The offences alleged against the petitioner are not punishable either with death or imprisonment for life. The petitioner even though was found on the spot in the vehicle has not been arrested. The petitioner is ready to co-operate with IO in investigation. With this, he prayed to allow the petition.

4. Per contra, learned Additional SPP would contend that the petitioner who was found transporting the cows, on enquiry has not produced any documents to show that he has purchased the cows. With this, he prayed to reject the petition.

5. Having heard the learned counsel, the Court has perused the FIR, complaint and other materials placed on record.

6. The petitioner is found transporting 7 Desi Cows in a vehicle KA-13 C 9189, without giving any proper food, water etc. It is the contention of the petitioner that he has purchased the cows in Hassan and he was taking them to his village for agriculture purpose. Even though the petitioner was present on the spot in the vehicle and even though he has been enquired by the complainant, the police have not arrested him. The petitioner has undertaken to co-operate with the police in the investigation and abide by any conditions to be imposed by this Court. The offences alleged against the petitioner are not punishable either with death or imprisonment for life.

7. Considering the above aspects, the petitioner has made out case for grant of anticipatory bail with conditions. In the result, the following:

ORDER Petition is allowed. Petitioner is ordered to be released on bail, in the event of his arrest, in Crime No.71/2025 of Ijoor Police Station, subject to following conditions:

(i) Petitioner shall voluntarily appear before the IO within
