ORAL ORDER

This petition is filed by accused Nos. 1 and 9 under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying to grant bail in Crime No.96/2025 of Malpe Police Station registered for the offences punishable under Sections 336(2), 336(3), 340(2), 316(5), 318(4) read with Section 3(5) of BNS, 2023 and Section 66(d) of Information Technology Act, 2000.

2. Heard the learned Senior counsel for the petitioner and the learned High Court Government Pleader for the respondent/State.

The learned Senior counsel for the petitioners would contend that, the alleged transfer of funds from the account of M/s.Piramal Finance Ltd. by this petitioner is based on e-mail received at the branch. The petitioners have not committed any offences as alleged. The petitioner No.2/accused No.9 is the husband of the petitioner No.1, and he is working as a HR Manager in a firm at Bangalore, and he has no role in commission of the alleged offences. The petitioners were taken to police custody between 10.09.2025 to 15.09.2025 for a period of five days, and they have been interrogated. Now the charge sheet has been filed, and therefore, the petitioners are not required for custodial interrogation. The offences alleged against petitioners are not punishable either with death or imprisonment for life. The petitioner No.1 is a woman. The petitioners are having a three year old dumb child, who is under treatment. With this, he prayed to allow the petition.

4. The learned High Court Government Pleader for the respondent/State would contend that, the accusations against the petitioners are serious committing breach of trust for personal gain. If the petitioners are granted bail, they will tamper the prosecution witnesses. With this, she prayed to reject the petition.

5. Having heard the learned counsel, the Court has perused the FIR, complaint and other materials placed on record.

6. The petitioner No.1/accused No.1 was working as Branch Manager in State Bank of India, Malpe Branch. She had authorized fifteen transactions and debited the account of M/s.Piramal Finance Ltd. and credited the amount to the accounts of accused Nos.2 to 8. The said transaction is stated to be based on an e-mail received at the branch. As per submission of the learned Senior Counsel for the petitioners that, the said e-mail received at the branch has been given effect and the amount has been transferred from the account of M/s.Piramal Finance Ltd. to the accounts of beneficiaries as per the said e-mail.

7. The petitioner No.2/accused No.9 is the husband of petitioner No.1/accused No.1. He is stated to be working as HR Manager in a firm at Bengaluru.
