ORAL ORDER
The present petition has been filed seeking for issuance of writ of mandamus by way of direction to the respondent - BDA to consider the representation at Annexure-G, made by the petitioner.
2. In terms of the representation, the facts made out are to the effect that, allotment of a site was made to Late Ramaiah on 28.02.2011 and Possession Certificate was also given. Further it is submitted that the lease-cum- sale agreement was executed in favour of said Ramaiah on 23.09.2014. It is further submitted that period of 10 years has lapsed since execution of lease-cum-sale agreement and the allottee is entitled for execution of an absolute sale deed. It is however submitted that, in the interregnum, the said Ramaiah, the original allottee died on 07.08.2022 and has executed a will bequeathing rights in favour of the petitioner herein. Accordingly, it is submitted that the request is made for execution of absolute sale deed in favour of the petitioner herein insofar the lease-cum-sale agreement executed in favour of Late Ramaiah.
3. Learned counsel for the respondent - BDA submits that the request of the petitioner would be considered as per law.
4. In light of the said stand, petition is disposed of. The request of the petitioner at Annexure-G, substance of which is referred to above, is to be considered and appropriate action be taken within a period of three months from the date of receipt of certified copy of this order.
5. Accordingly, petition is disposed of. All contentions are kept open.
