ORAL ORDER
This petition is filed by accused No.2 under Section
482 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant anticipatory bail in Crime No.216/2025 of Chintamani Town Police Station, registered for offences punishable under Sections 319(2), 318(4), 318(2), 336(2), 338 and 336(3) of Bharatiya Nyaya Sanhita, 2023.
2. Heard learned counsel for petitioner and learned High Court Government Pleader for respondent -
State.
3. Learned counsel for petitioner would contend that, the petitioner is a bonafide purchaser of the property for consideration under registered Sale Deed. The petitioner is not aware of anything with regard to person who has executed Sale Deed of impersonating the father of the complainant who is stated to have died on 16.05.2023. The complainant is having right to challenge the said Sale Deed in Civil Court. The petitioner is ready to cooperate with the Police in investigation and abide by any conditions to be imposed by this Court. The offences alleged against the petitioner are not punishable either with death or imprisonment or life. With these, he prayed to allow the petition.
4. Per contra, learned High Court Government Pleader for respondent would contend that, the matter is under investigation. There are serious allegations against this petitioner creating Sale Deed in collusion with other accused. The petitioner is required for custodial interrogation. With these, he prayed for dismissal of the petition.
5. Having heard the learned counsels appearing for parties, the Court has perused the FIR, complaint and other materials placed on record.
6. The petitioner is purchaser of the property bearing Survey No.17/1 measuring 04 acres 08 guntas situated at Masilahalli Village under Sale Deed dated 17.08.2025 and it is a registered Sale Deed. The allegation in the complaint is that, the said property is standing in the name of father of the complainant i.e., Sri. Ashwathanarayana but the said Sale Deed executed is by a person by Ashwathanarayana, S/o. Doddabyrappa, aged seventy six (76) years. It is alleged in the complaint that the owner of the said property i.e., Sri.Ashwathanarayana, the father of the complainant died on 16.05.2023. It is alleged that the accused persons created Sale Deed in respect of the property standing in the name of deceased father of the complainant. It is submitted that the petitioner has purchased the property under Sale Deed dated 17.08.2025 and it is a registered Sale Deed for consideration of Rs.9,25,000/-. The said Sale Deed has not been challenged by the complainant. The petitioner is ready to cooperate with the Police in investigation. The offences alleged
