ORAL ORDER

Heard Sri.B.N.Jagadeesha, learned Addl. SPP appearing for the petitioner and have perused the material on record. 2. The petitioner is the State, is at the doors of this Court calling in question the order of the concerned Court dated 7.6.2022, which grants statutory bail as obtaining under Section 167(2) of Cr.P.C.

3. A perusal at the order impugned would indicate that the police have filed a charge sheet prior to the expiry of 90 days but have withdrawn the charge sheet to file a fresh or a separate charges sheet. In that light, there is no separate charge sheet filed in the eye of law. The charge sheet not having been filed within 90 days as obtaining under Section

167 of Cr.P.C., the order impugned in the subject petition would not warrant any interference as the accused has already been enlarged on bail on the said score.

4. Petition lacking in merits, stands rejected Sd/-
