THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER

1. Petitioner is before this Court seeking for the following reliefs:

(a) ISSUE A WRIT OF MANDAMUS or any other appropriate writ, order or direction, directing the Respondents to issue the death certificate of Late KS Narendra Babu without inserting the name of any person as spouse of Late KS Narendra Babu, in accordance with law.

(b) Pass such other order as this Hon'ble Court may deem fit in the facts and circumstances of this case, in the interest of justice and equity.

(c) ISSUE A WRIT OF CERTIORARI or any other appropriate writ, order or direction, quashing the endorsement bearing No. Aa.Vy(Ya.Va)/Ja.Ma./PR/17/25-26 dated 24.07.2025 issued by the Respondent BBMP produced at ANNEXURE -L.

2. The petitioner had made an application to respondent No.2 for issuance of death certificate of one Sri. K.S.Narendra Babu, the brother of the petitioner, without the name of any person as his spouse. The said application came to be rejected vide order dated 24.07.2025 at Annexure-L on the ground that there is no provision for deletion of any name already entered in the register of deaths.

3. The Co-ordinate Bench of this Court vide its order dated

11.01.2021 in W.P.No.39163/2019 in the case of Smt. Chikkamma vs. The Chief Registrar of Births and Deaths has come to a categorical conclusion that if there is any defect which is pointed out in the register of births or register of deaths, the same could be rectified by issuing appropriate notice to the concerned persons and holding a due enquiry in relation thereto.

Faced with the above situation, learned counsel for respondent Nos.1 and 2 submits that the respondents would issue a notice to the concerned, conduct an enquiry and act in terms of the order passed in Chikkamma's case supra. The said submission answers the grievance of the petitioner. In that view of the matter, I pass the following:

ORDER

i) Writ petition is allowed ii) A certiorari is issued. The endorsement bearing No.Aa.Vy.(Ya.Va)/Ja.Ma/PR/17/25-26 dated

24.07.2025 at Annexure-L is quashed.

iii) The matter is remitted back to respondent No.2 for fresh consideration in terms of the directions issued by this Court in Chikamma's case supra.
