ORAL ORDER
This petition is filed by accused No.1 under Section
482 of Bharatiya Nagrika Suraksha Sanhita, 2023 praying to grant anticipatory bail in Crime No.310/2025 of Madivala Police Station registered for offences punishable under Sections 316(4) and 318(4) of Bharatiya Nyaya Sanhita, 2023.
2. Heard learned counsel for petitioner and learned Additional State Public Prosecutor for respondent -
State.
3. Learned counsel for petitioner would contend that, the petitioner has sought promotion and increment and therefore, a false complaint has been filed. There is a delay in filing the complaint. The petitioner has now resigned from 14.10.2025 as he has not been given promotion and not hiked his salary. The customers used to deposit the amount to the bank account of this petitioner and he used to withdraw the said amount and give it in cash to his employer. The petitioner is ready to cooperate with the Investigating Officer in investigation and abide by any conditions to be imposed by this Court. With these, he prayed to allow the petition.

Per contra, learned Additional State Public Prosecutor for respondent would contend that, the petitioner has collected huge money from the customers to his account in order to get job in foreign countries. The petitioner did not give that amount to the employer. The petitioner not only collected money from the persons whose names are mentioned in the complaint but also collected the money from others. The bank account statement of the petitioner itself indicates that, a total sum of amount deposited in the bank account of the petitioner is Rs.1,02,20,233/- within a period of 1½ years itself indicates that, he has received huge amount from the customers. The complaint itself indicates that the petitioner has collected totally Rs.52,00,000/- from the customers and misappropriated it. The investigation is in progress. The petitioner is required for custodial interrogation. With these, he prayed for dismissal of the petition.
5. Having heard the learned counsels appearing for parties, the Court has perused the FIR, complaint and other materials placed on record.
6. A case has been registered against the petitioner in Crime No.310/2025 of Madivala Police Station for aforesaid offences on the complaint of one Smt. Pallavi R. The allegation in the said complaint is that the petitioner was working in the company of the complainant and he has collected Rs.52,55,000/- from twenty(20) persons through his account and not credited or given the said amount to the company and has misappropriated it. The said offence has taken place between 03.04.2024
