THIS WRIT PETITION IS FILED UNDER ARTICLE 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT OF MANDAMUS DIRECTING THE RESPONDENTS TO REMOVE THE BLOCKAGE ACROSS THE DRAINAGE AND ALLOW THE DRAIN WATER FREELY FLOWS AND TO MAINTAIN THE DRAINAGE PROPERLY WITHOUT CAUSING HEALTH HAZARDOUS TO THE PEOPLE AROUND THE LOCALITY, IN SO FAR AS THE PETITIONERS CONCERNED AND ETC.

THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER

1. The petitioners are before this Court seeking for the following reliefs;

i. Issue a writ of mandamus directing the Respondents to remove the blockage across the drainage and allow the drain water freely flows and to maintain the drainage properly without causing health hazardous to the people around the locality.

ii. To grant such other reliefs as deemed to fit under the facts and circumstances of the case, in the interest of justice and equity.

2. The grievance of the petitioner was that drainage/

sewage was flowing into the land of the petitioner and not being cleaned by the respondents. Thus, adversely affecting the use of property of the petitioner in Survey No.7 of Chandakavadi Village and Hobli, Chamarajanagara Taluk.

3. Notice having been issued, respondents have entered appearance.

4. Sri.Shubhankar.C., learned counsel on behalf Sri.Chandrakanth.R.Goulay., learned counsel for respondent No.1, 3 and 4 submits that the blockages in the sewage/drainage system have been removed and thereafter there has been no excess flow of the sewage into the land of the petitioner. Furthermore, a resolution having been passed by Grama Panchayath for implementation of a Sewage Treatment Plant, the said plant would be established by April-2026.

5. The said submission of learned counsel for respondents No.1, 3 and 4 answers the grievance of the petitioner. The undertaking/submission of learned counsel for respondents No.1, 3 and 4 is placed on record and is expected that the Sewage Treatment Plant is established by end of April-2026.

6. With the observation, the writ petition stands disposed of.
