ORAL JUDGMENT

The parties are present before the Court. They have been identified by their respective counsel. They have submitted the photocopies of their Aadhar Cards.

2. We have perused the Memorandum of Compromise Petition filed on 31.01.2026. The parties have settled their disputes amicably, voluntarily and peacefully without any coercion on the terms of settlement mentioned in the aforesaid Memorandum of Compromise Petition.

3. The parties who are present in Court affirmed that they have signed this Memorandum of Compromise Petition voluntarily. The Memorandum of Compromise Petition is signed by both the parties and by their respective Advocates, and it is also supported by the joint affidavit of both the parties.

4. The present appeals are filed by the wife challenging the judgment and decree dated 20.09.2024 passed in MC No.97/2023 connected with MC No.61/2020. By means HC-KAR of the aforesaid judgment and decree, the petition in MC No.61/2020 filed by the husband under Section 13(1)(i) of the Hindu Marriage Act,1955, H.M. Act, 1955 was allowed. The petition in MC No.97/2023 filed by the wife under Section 9 of the said H.M.Act,1955 for restitution of conjugal rights was dismissed.

5. In view of the settlement aforesaid, the parties shall remain bound by the terms of the settlement. The decree of divorce granted by the Principal Senior Civil Judge and CJM at Mandya in MC No.61/2020 dated 20.09.2024 is confirmed. The terms incorporated in the Memorandum of Compromise Petition shall form part of the decree.

6. It is stated by the parties that an amount of Rs.8,00,000/- (Rupees Eight Lakhs only) towards permanent alimony as envisaged in Para 5(a) of the Memorandum of Compromise Petition has been handed over by way of Demand Draft today in Court.

7. The amount of Rs.5,00,000/- (Rupees Five Lakhs only) as envisaged in Paragraph 5(b) of the Memorandum of Compromise Petition has been deposited in the account of the
