1. The applicant in Application No.10128/2026 before
the Karnataka State Administrative Tribunal, Belagavi (in short
‘KAT’) has maintained this petition praying for a Writ of Certiorari
or any other order or direction, quashing the impugned order
dated 27.01.2026 passed therein and to issue any other
appropriate writ or order or direction which deems fit to grant by
this Court in the facts and circumstances of the case.
2. The applicant is a permanent government servant
working as Village Administrative Officer in the Revenue
Department, presently posted at Kitturu in Belagavi District. He
is the President of the Karnataka State Government Employees
Association, Taluka Unit Channamma Kitturu (in short, ‘the
Association’) for the period 2024 to 2029. On 14.12.2025,
Respondent No. 2 issued an order deputing the applicant to
Shinnur Village in Nippani Taluk for a period of one year with

immediate effect. Aggrieved by this, the applicant approached
the KAT praying to quash the deputation order. In the said
proceeding he also sought interim protection by staying the
operation of the deputation order. The KAT, vide its order dated
27.01.2026, declined interim relief mainly on the ground that the
transfer guidelines for 2025-26 were not applicable to deputation
and directed issuance of emergent notice to the Respondents. In
these circumstances, the applicant has approached this Court.
3. Admittedly, the Government of Karnataka issued
guidelines for the transfer of government servants during 2025-
26 vide G.O.No.Si.Aa.Su.E.14 Se.Nou.Va 2025, Bengaluru dated
12.05.2025. Guideline No.8(5) stipulates that if a government
servant is an office-bearer of the Karnataka State Government
Employees Association, he shall not be transferred until the end
of his term of office. Undisputedly, the applicant was elected
President of the Karnataka State Government Employees
Association, Taluka Unit Channamma Kitturu on 28.10.2024,
with tenure from 2024 to 2029. Thus, based on the aforesaid
Government Order, the applicant enjoys immunity from transfer
till the end of his term as President of the Association.
