ORAL ORDER

The petitioners have called in question the order dated

03.11.2025 passed by the Deputy Commissioner, Uttara Kannada District, in RP No.26/2025 (Annexure-D), whereby the revision preferred by the private respondent came to be allowed and the order passed by the Assistant Commissioner, Sirsi Sub-Division in RA No.19/2025 dated 08.08.2025 (Annexure-C), directing mutation of the petitioners name in the revenue records was set aside, as also the order dated 12.12.2023 passed by the Tahasildar, Mundagod Taluk, (Annexure-B), rejecting the petitioners request for mutation.

2. Brief facts The petitioners purchased land bearing Sy. No.172 hissa No.4, measuring 3 acres 20 guntas situated at Salagav village, Mundagod Taluk, Uttara Kannada District under a registered sale deed dated 10.10.2023. Consequent upon the purchase, the petitioners sought mutation of their names in the revenue records.

3. The Tahasildar by order dated 12.12.2023 rejected the request for mutation. Aggrieved thereby, the petitioners preferred an appeal before the Assistant Commissioner in RA No.19/2025, which came to be allowed directing mutation of the petitioners’ names in the revenue records. Subsequently, the private respondent filed revision petition before the Deputy Commissioner in RP No.26/2025 contending that the regular second appeal (FR No.100874/2024) is pending before this Court. Accepting the said contention, the Deputy Commissioner allowed the revision and set aside the order of the Assistant Commissioner.

4. Learned counsel for the petitioners would contend that the revenue authorities are bound to enter the name of the purchaser, and mutation is a ministerial and a fiscal act, unless there is a subsisting injunction or stay order by the competent Civil Court. It is submitted
