ORAL ORDER

Petitioner Nos.1 to 3 and respondent No.2 submitted that the dispute between the parties is settled amicably and that they are reporting settlement.

2. They have filed the application under Section 482 read with Section 320 of Cr.P.C seeking permission of the Court to enter into compromise and also seeking to allow the petition by quashing the criminal proceedings.

3. Petitioner Nos.1 to 3 and respondent No.2 are present before the Court and they are identified by their respective counsel.

4. Petitioner Nos.1 to 3 and respondent No.2 filed their joint affidavit which reads a under:

"WE, 1) Mohammed Mudasirulla S/o Mohammed Rahimulla, aged about 36 years 2) Mohammed Rahimulla, S/o Mohammed Hayath, aged about 73 years, 3) Mallika Banu, W/o Mohammed Rahimulla, aged about 62 years, all are residing at No.2, 1st Floor, 2nd Cross, Manorayanapalya, Sultanpalya Main Road, Bengaluru-560032, and 2) UMME HANI, D/o Late. Sanualla Khan, aged about 27 years residng at No.11/1,3rd Main, Kempaiah Block, J.C.Nagar, Bengaluru do hereby solemnly affirm and state on oath as follows;

1. We the above submit that the respondent No.2 has filed criminal petition No.50/2018, maintenance in M.M.T.C-IV Bengaluru and she has filed a case against the present petitioners in East Zone Women P.S for the offences punishable U/s

498-A, 323, of I.P.C and Sec.3 & 4 of D.P Act.

2. We state that at the intervention of elders the is settled the petitioners has paid Rs.5,00,000/-, i.e, Rs.3,00,000/ by way of Demand draft bearing No.574225, 574224 and a sum of Rs.2,00,000/- has been paid by way of cash to the respondent No.2. 3. We state that we have obtained Khula Nama as per Shariath law and the child will be with the custody of the mother. Hence prays to compound the offence and permit to compromise matter in the interest of justice."

5. Petitioners and respondent No.2 admit the contents of the joint affidavit and pray for allowing the petition.

6. Respondent No.2 specifically submits that, she has received Rs.5,00,000/- i.e., Rs.3,00,000/- by way of Demand Draft and a sum of Rs.2,00,000/- in cash as mentioned in the affidavit. She has no objection to allow the petition and to quash the criminal proceedings initiated against the petitioners.

7. Considering the relationship between petitioner No.1 and respondent No.2, they being husband and wife and the nature of the allegation for the offence punishable under Sections 498-A, 323 of IPC and Sections 3 and 4 of the Dowry Prohibition Act, I am satisfied with the settlement arrived at between the parties. Hence, IA.No.1/2026 is allowed, the parties are permitted to compound the offence.
