Facts of the case:
Original claimants sought re-grant of land formerly held as a village office. The primary dispute involved establishing the status of the ancestor as the 'holder of the village office' and the validity of a sale deed executed in 1971 by an alleged successor to a purchaser. The lower appellate court set aside the order of the initial authority, concluding that the claimants failed to establish their status as the rightful holders and that the original records were insufficient to prove the claim or the nature of the property as an assigned village office.

Findings of Court:
Evidence relying on photocopies of internal registers without proper authentication and containing blank columns or inconsistent details is insufficient to establish the status of a 'village office holder'. The court held that without corroborating evidence or establishing the pedigree and the specific nature of the land grant under the Act, the claim for re-grant cannot be sustained. The court also observed that the purchasers in possession since 1971 acquired interests, the status of which are subject to proceedings, but the burden remains with the petitioner to prove their own entitlement, which was not discharged.

Issues: Whether the petitioners established themselves as 'holders of a village office' eligible for re-grant; whether the reliance on an unverified extract of a register was sufficient to override the findings of the lower appellate court; and whether the sale of the property during the pendency of proceedings affected the right of the transferor to prosecute the claim.

Ratio Decidendi: A person claiming re-grant under the Act must strictly establish their status as a 'holder' or successor. Merely performing service without proper documentation or official recognition as a village officer does not confer the right to re-grant. The burden of proof lies heavily on the applicant to clear discrepancies in revenue records, and in the absence of original, authenticated registers, findings of fact by the first appellate court cannot be interfered with under Article 227 unless clearly perverse.

Result: Writ petition dismissed.
