IN THE HIGH COURT OF KARNATAKA, AT DHARWAD
Jyoti M, J
SMT PAVITRA JAIN W/O LATE PRAKASH J – Appellant
Versus
THE CHILD DEVELOPMENT OFFICER – Respondent
WP No. 105487 of 2024
For the Appellants/Petitioners: Vinaykumar Bhat
For the Respondents: Girija Hiremath, Pruthvi K.S.
The court issued a writ of mandamus directing the administrative authorities to consider a government employee's representation for transfer on compassionate grounds in accordance with the applicable law.
Headnote:The petition was filed under Articles 226 and 227 of the Constitution of India. The petitioner, an Anganawadi worker appointed in 2008, sought a transfer to her native place following the death of her husband in 2015. Although a transfer was granted, she was posted to a center other than the one requested, leading her to submit a representation on 01.04.2023 for a transfer to a specific center. The primary issue was whether the respondents should be directed to consider the petitioner's representation for transfer. The court observed that the petitioner's grievance regarding the specific location of her posting remained unaddressed. This Court is ordering mandamus directing the respondents to consider the grievance/representation submitted by the petitioner on 01.04.2023, in accordance with law within four weeks from the date of receipt of certified copy of this order, if not considered as of today.
