THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER

1. In this writ petition, the petitioner has sought for the following relief/s:

“I) Issue a writ in the nature of mandamus direct the respondent to fix the monthly pension and pensionary benefits of the petitioner from the date of their superannuation and pay the arrears forthwith and also continue to pay the monthly pension regularly as and when it falls due as per representation dated 17.02.2025 and 17.11.2025 (Annexure- C and D).

II) Direct the respondents to pay the interest @ 18% per annum on the arrears of monthly pension and Pensionary Benefits payable to the petitioner from the date of his retirement till the date of the payment and;

III) Direct the Respondents to pay Litigation cost of Rs. 50,000/- to the Petitioner.

IV) Grant such other relief/s as deems fit by this Hon'ble Court considering the facts and circumstances of the case including the costs, in the interest of justice and equity.”

2. The case of petitioner is that he is a retired employee of respondent No.1–University and he retired from service on 31.05.2024. Immediately after his retirement, he submitted all the relevant papers and documents for disbursement of his pension. Even after the lapse of more than one year and seven months, his pensions has not been settled. Therefore, he submitted representations dated 17.02.2025 and 17.11.2025 vide Annexures–C and D, respectively. Since the said representations have not been considered, he is before this Court.

3. Learned counsel appearing for respondent No.1- University submits that the representations submitted by the petitioner will be considered in accordance with law, if this Court grants some reasonable time.

4. In view of the above, without expressing any opinion on the merit of the case, the writ petition is disposed of.

5. Respondent No.1 is directed to consider the representations dated 17.02.2025 and 17.11.2025 vide Annexures–C and D, respectively, for settlement of retirement benefits and monthly pension, including interest, in accordance with law, as expeditiously as possible, not later than eight weeks from the date of receipt of a certified copy of this order.
