THIS WRIT PETITION IS FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO ISSUE A WRIT IN THE NATURE OF MANDAMUS DIRECT THE RESPONDENT TO FIX THE MONTHLY PENSION OF THE PETITIONER FROM THE DATE OF THEIR SUPERANNUATION AND PAY THE ARREARS FORTHWITH AND ALSO CONTINUE TO PAY THE MONTHLY PENSION REGULARLY AS AND WHEN IT FALLS DUE AS PER REPRESENTATIONS DATED: 18.06.2024 AND 3.11.2025 VIDE (ANNEXURE- J,K, L & M) AND ETC.

THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:

ORAL ORDER

1. In this writ petition, the petitioners have sought for the following relief/s:

“i. Issue a writ in the nature of mandamus direct the respondent to fix the monthly pension of the petitioner from the date of their superannuation and pay the arrears forthwith and also continue to pay the monthly pension regularly as and when it falls due as per r representations dated: 18.6.2024 , 3.11.2025 (Annexure-J,K, L & M);

ii. Direct the respondents to pay the interest @ 18% per annum on the arrears of monthly pension payable to the petitioner from the date of his retirement till the date of the payment and;

iii. Direct the Respondents to pay Litigation cost of Rs. 50,000/- to the Petitioners.

iv. Grant such other relief/s as deems fit by this Hon'ble Court considering the facts and circumstances of the case including the costs, in the interest of justice and equity.”

2. The case of petitioner Nos.1 to 4 is that they are retired employees of respondent No.1–University and they retired from service on 31.12.2023, 31.05.2023, 30.06.2024 and 30.06.2025, respectively. Immediately after their retirement, they submitted all the relevant papers and documents for disbursement of their pensions. Even after the lapse of more than two years in respect of petitioner Nos.1 and 2, one year in respect of petitioner No.3, and six months in respect of petitioner No.4, their pensions have not been settled. Therefore, they submitted representations vide Annexures–J and K dated 18.06.2024 and Annexures-L and M dated 03.11.2025. Since the said representations have not been considered, they are before this Court.

3. Learned counsel appearing for respondent No.1- University submits that the representations submitted by the petitioners will be considered in accordance with law, if this Court grants some reasonable time.

4. In view of the above, without expressing any opinion on the merit of the case, the writ petition is disposed of.

5. Respondent No.1 is directed to consider the representations vide Annexures–J and K dated 18.06.2024 and Annexures-L and M dated 03.11.2025 for settlement of retirement benefits and monthly pension, including interest, in accordance with
