ORAL JUDGMENT

The present intra Court appeal has been filed impugning the judgment and order dated 15.10.2025 passed by the learned Single Judge in W.P.No.11078/2020.

2. The parties are referred to as per their ranking before the Writ Court, for the sake of convenience.

3. The petitioner claims to be in unauthorized occupation of land to an extent of 2 acres 4 guntas in Sy.No.8 of Channenahalli, Kilkeri Hobli, K.R.Pet Taluk. The petitioner challenged the order passed by the Deputy Commissioner, whereby the Deputy Commissioner had modified the order of the Assistant Commissioner and disposed of the appeal by directing the respondents to reserve an extent of 1 acre 8 guntas for Ashraya Scheme.

4. The petitioner seeks regularization of the entire land which is allegedly in his unauthorized occupation i.e., 2 acres and 4 guntas. Out of the said land, 1 acre and 8 guntas has been reserved for Ashraya Scheme. The land in question is a Government land, and it is for the Government to utilize the land for public purposes. The petitioner does not have any legal or fundamental right to seek regularization of his unauthorized occupation. The Government has taken a decision to reserve 1 acre and 8 guntas of land for Ashraya Scheme.

5. We do not find any reason to interfere with the impugned judgment and order passed by the learned Single Judge. There is no merit and substance in this appeal. Accordingly, the writ appeal is dismissed.
