Though the appeal is listed for admission, with consent of both the learned counsel appearing on behalf of the parties, the matter is taken up for final disposal.

This Regular Second Appeal is filed by the defendants calling in question the judgment and decree dated 22.01.2025 passed in R.A.No.16 of 2024 by the Senior Civil Judge and JMFC, Banahatti1, which confirmed the judgment and decree dated 16.09.2022 passed in O.S.No.67 of 2015 by the Civil Judge and JMFC, Banahatti2 by dismissing the regular appeal on the application I.A.No.I filed under Section 5 of the Limitation Act, 1963, seeking to condone the delay.
