CAV ORDER

(PER: HON'BLE MR. JUSTICE VIJAYKUMAR A. PATIL) This petition is filed under Article 226 of the Constitution of India by the wife of the detenue seeking prayer to set free the detenue by issuing a writ in the nature of Habeas Corpus and to direct the respondent Nos.2 to 6 to produce the detenue who is in illegal custody of the respondent No.4, before this Court. The petitioner further prays for an order/direction to the respondent No.4 to produce all CCTV footage/recordings maintained by the Gangammana Gudi police from 14.10.2025 till date.

2. The brief facts leading to the filing of this petition are that on 14.10.2025 at about 9 a.m. the husband of the petitioner left the house to attend his daily work and at about 1 p.m. on the said day, the petitioner's wife received a call and it was informed to her that the detenue has been taken by the CCB Police, Bangalore near the Satellite Bus Stop. It is averred that the petitioner tried to call the detenue but the mobile was switched off and on 15.10.2025, the petitioner visited Byadarahalli Police Station and tried to register a missing complaint. However, the police informed her to visit whenever they make a request. It is further averred that on 16.10.2025, the petitioner was informed that the respondent No.4- police detained her husband and accordingly she visited the police station and met respondent No.8. He facilitated the petitioner to meet the detenue who was in custody. It is also averred that the respondent No.8 demanded Rs.7,00,000/- to release the detenue and thereafter, the petitioner approached the Karnataka State Human Rights Commission (hereinafter referred to as 'the Commission'), lodged a complaint against the police atrocities and the official of the Commission visited the police station.
