ORAL ORDER

Heard Sri.Harish Kumar.M.C learned counsel for the

petitioner.

2. In the light of the limited relief sought for, this

Court is of the view that notice to respondent can be

dispensed with and accordingly, notice to respondent is

dispensed with.

3. This writ petition is filed seeking a direction to

the Court of Senior Civil Judge Arasikere to dispose of

M.C.No.15/2021 which is pending on its file time bound.

4. Learned counsel for the petitioner submits that

petitioner filed a petition seeking a decree of divorce in the

year 2019. The said case was transferred to the Court of

Senior Civil Judge, Arasikere in the year 2021. Thus, the

case is pending for disposal since more than 6 years. The

Court of Senior Civil Judge, Arasikere is adjourning the

matter time and again and thereby there is no progress in

the case since long time. Therefore, a direction may be

issued to the Court to dispose of the case time bound.

5. Record discloses justification in the submission

that is made by learned counsel for the petitioner. The

certified copy of the order sheet discloses that the Court

has not given any reasons for adjourning the matter on

multiple occasions. Also, as rightly submitted the case is

pending since long time. Therefore, this Court considers

desirable to direct the Court of Senior Civil Judge,

Arasikere to dispose of the matter time bound. Thus, the

following:

ORDER

(i) The writ petition is allowed

(ii) The Court of Senior Civil Judge, Arasikere is

directed to dispose of M.C.No.15/2021 which is

pending on its file as expeditiously as possible,

preferably within a period of three months from

the date of receipt of copy of this order.

(iii) On each and every date of hearing, progress of

the case or the reasons for adjournment shall

be recorded with all details till the disposal of

the case from the date of receipt of copy of

their order.

(iv) Registry to send copy of this order to the

concerned Court forthwith.
