Facts of the case:
The petitioner (defendant no.1) challenged an order rejecting an application under Order VII Rule 11 (d) of the CPC. The respondents had filed a suit for partition despite having entered into a compromise decree in an earlier suit concerning the same properties. The respondents alleged fraud and misrepresentation regarding the earlier compromise while adding new properties and parties to the current suit to bypass maintainability issues.

Findings of Court:
The Court held that the trial court erred in failing to recognize the bar under Order XXIII Rule 3A of the CPC. The Court emphasized that allegations of fraud related to a compromise decree must be addressed by the court that recorded the compromise and not through an independent suit.

Issues: Whether a separate suit is maintainable to challenge a compromise decree on the grounds of fraud, and whether properties allegedly omitted in a previous partition suit can be added via a new suit.

Ratio Decidendi: A party aggrieved by a compromise decree must seek recourse in the same court that passed the decree to prove the invalidity of the agreement; filing a separate suit is barred by Order XXIII Rule 3A of the CPC.
