ORAL ORDER

The petitioners - accused Nos.1 to 5, 7 and 8 are before

this Court calling in question proceedings in S.C.No.305/2024,

pending before the LXIX Additional City Civil and Sessions

Judge, Bengaluru, for the offences punishable under Sections

341, 120B, 143, 147, 148, 149, 307 and 324 of the IPC.

2. Heard Sri K. Ram Singh, learned counsel appearing

for the petitioners; Smt. Sowmya R., learned High Court

Government Pleader appearing for respondent No.1 and

Sri Sampath Kumar A.V., learned counsel appearing for

respondent Nos.2 and 3.

3. The petitioners along with other accused persons

hatched conspiracy to eliminate respondent No.2 – complainant

and as a result of which, all the accused persons assault

respondent No.2, due to which respondent No.2 – complainant

suffers injuries on his person. This becomes a crime in Crime

No.383/2018, for the afore-quoted offences. Police after

conduct of investigation file their final report – charge sheet in

S.C.No.305/2024 before the concerned Court.

4. The issue is not with regard to the pendency of the

merit of the matter. During the subsistence of these

proceedings, the parties to the lis file an application under

Sections 320 r/w. 482 of the Cr.P.C., seeking permission to

compound of the offences mentioned in the FIR along with a

joint affidavit. Learned counsel for the parties also produce a

copy of the wound certificate of respondent No.2 – complainant

to contend that the injuries suffered by the complainant is

simple in nature and pray for quashing of the criminal
