ORAL ORDER
The present writ petition is filed seeking following prayer:
"In view of the above said facts, reasons and relative circumstances of the case, the Petitioner Bank prays that this Hon'ble Court may be pleased to:
(a) call for the entire records leading to passing of the order dated 27.02.2026 in SA No. 364/2025 passed by Debts Recovery Tribunal-I at Bengaluru and on perusal of the same:
(b) issue a writ of certiorari or any other appropriate writ, order or direction setting aside the impugned order dated 27.02.2026 in SA No. 364/2025 passed by the Debts Recovery Tribunal-I at Bengaluru, Annexure-
M.
(c) issue any other direction or order or writ as deemed just in the circumstances and the probabilities of the case and the same may kindly be considered in the interest of justice and equity."
2. The Bank has approached this Court questioning the order passed by the DRT and the remedy available to the Bank as regularly canvassed by the advocates for the Bank is before the DRT and the Bank also stands in the similar footing as that of the borrower.
3. In that view of the matter, this Court is passing the following:
ORDER
i. Accordingly, the writ petition is disposed of giving liberty to the petitioner/Bank to avail the appropriate remedy before the DRAT.
ii. All pending I.As., in the writ petition shall stand closed.
