Facts of the case:
The appellant was convicted for offenses under the IPC and the SC/ST (POA) Act, 1989, following allegations of assaulting the complainant and his wife and abusing them in the name of caste. The appellant contended that he was falsely implicated due to his role in reporting the illegal fishing activities of the witnesses.

Findings of Court:
The court observed significant discrepancies in the testimonies of the prosecution witnesses, noting their shared motive and personal animosity against the appellant. The prosecution failed to establish the occurrence of the incident in "public view" as required for the SC/ST Act, and failed to prove the specific caste-based insults.

ORAL JUDGMENT

This appeal is by the accused being aggrieved by the Judgment of conviction and Order of Sentence dated 23.04.2015 in Spl.Case.No.69/2013 on the file of the VI Additional District and Special Judge at Mysuru, wherein the accused/appellant herein has been convicted and sentenced for the offences punishable under Sections 504, 324, 448, 323, 354 of the Indian Penal Code, 1860 [for short, the 'IPC'] and Section 3(1)(x) and (xi) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 [for short, the 'Act'].

2. It is the case of the prosecution that a complaint as per Exhibit P.3 came to be filed by one Venkata Swamy which reads as under:
