ORAL ORDER
1. Office has raised objection with regard to the
maintainability of revision petition.
2. Revision petitioner is the defacto complainant
challenging the Order of acquittal passed in Criminal Appeal No.66/2025 reversing the judgment passed in C.C. No.1284/2024 convicting the accused for the offence under Section 138 of the Negotiable
Instruments Act.

3. Against such an order of the First Appellate Court, an
appeal lies. Therefore, a memo is filed on behalf of
the revision petitioner. Memo reads as under :
"The petitioner seeks leave of this Hon'ble Court to withdraw the above revision petition as appeal has to be filed. The petitioner seeks liberty to prefer the appeal. Hence this memo to withdraw the above revision in the
interest of justice."
4. Placing the memo on record, criminal revision
petition is dismissed as withdrawn with liberty as
prayed for.
5. Time spent before this Court in this revision shall be
excluded while computing the period of limitation
under Section 14 of the Limitation Act.
6. Certified copies of the records are to be returned
after keeping the photocopy.
