ORAL ORDER

Heard the learned counsel for the petitioner, the

learned HCGP for the respondent–State.

2. This petition is filed by the petitioner/accused

under 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail and praying for the following

relief:

a) Wherefore, it is most respectfully prayed that, this Hon’ble Court may be pleased to enlarge the petitioner on bail who is being arrayed as accused in Crime No.44/2026, registered before respondent authorities (Savanur Police Station, Savanur), for the offences punishable u/s 329(4), 109(1) and

352 of BNS, 2023.

b) Any other appropriate relief that, this Hon’ble Court deems just and proper in the circumstances of the case may please be passed, in the interest of justice and

equity”.

3. The brief case of the prosecution is that the

petitioner entered the house of the complainant and saying

that he has illicit relationship with his wife and suddenly stabbed his stomach with an intention to murder the complainant. Based on these allegations complainant is lodged and crime has been registered against the accused

for the aforesaid offences.

4. It is a serious allegation against the

petitioner/accused that he attempted to murder the complainant by stabbing him in the stomach. Since the investigation is ongoing and the charge sheet has not yet been filed, if the petitioner is enlarged on bail at this stage, there is a likelihood of his absconding, threatening prosecution witnesses, or fleeing from justice. Hence, the

petition is liable to be dismissed and is hereby dismissed

5. However, liberty is reserved to the petitioner to

file a fresh petition after the filing of the charge sheet.
