The involvement of an offending vehicle in a motor accident is sufficiently established through police charge sheet records and witness testimony, and appellate courts will maintain standard interest rates on compensation awards unless exceptional circumstances justify a higher rate.

Headnote:(A) Motor Vehicles Act, 1988 - Section 173(1) - Compensation - Enhancement - Accident involving death - Appellant-Insurer questioned the involvement of vehicle - Evidence and police records, specifically the testimony of the Head Constable, sufficiently established the involvement of the lorry - No evidence to discredit the police investigation.

(B) Motor Vehicles Act, 1988 - Compensation - Interest rate - Tribunal awarded 9% interest without exceptional circumstances - Appellate court reduced the interest to 6% in line with prevailing standards, absent special justification for a higher rate.

(C) Motor Vehicles Act, 1988 - Quantum of compensation - Deceased worked as a mason - Income calculation based on annual chart - Enhancement allowed based on Rs. 11,000/- monthly income, addition of future prospects, and mandatory escalation on conventional heads. (Paras 12, 16, 17, 20, 21).

Facts of the case:
The deceased died in a road traffic accident on 12.09.2017 when his motorcycle was hit by a lorry. The claimants filed for compensation. The insurer disputed the involvement of the lorry, but the trial court upheld the claim and awarded compensation with 9% interest. Both the insurer and the claimants appealed the judgment.

Findings of Court:
The court found that the involvement of the offending vehicle was sufficiently proven by the investigation and evidence led during the trial. The court, however, reduced the interest from 9% to 6% and enhanced the total compensation to Rs. 24,94,000/- based on a revised income calculation.

Issues: Whether the insurer made a case for non-involvement of the vehicle and whether the claimants were entitled to an enhancement of compensation.

Ratio Decidendi: The court established that where police records and witness testimony confirm the involvement of a vehicle, the insurer’s plea of non-involvement is untenable. Furthermore, compensation for a fatal accident must align with standardized charts for notional income adjusted for the year of the accident.

Result: Appeals allowed in part.
