(B) Motor Vehicles Act, 1988 - Section 10(2) - Liability of Insurer - Driving License validity - Mere possession of license for 3-wheeler vehicle does not invalidate policy coverage for light motorcycles unless unladen weight restriction of 7,500 KG is breached - Following Mukund Dewangan, liability maintained on Insurer. Facts of the case:
A motorcycle accident on 11.10.2016 caused the death of one minor and injuries to another. Claimants sought enhancement of compensation, while the Insurance Company challenged the liability based on the driver's license specifications.

Findings of Court:
The Court enhanced the compensation for the deceased's legal representatives from Rs.5,78,836/- to Rs.14,78,836/-, dismissed the Insurance Company's appeals on liability, and confirmed the award for the injured claimant.

Issues: The issues were the adequacy of the compensation quantum for the deceased minor and whether the Insurance Company was absolved of liability due to the driver's license type.

Ratio Decidendi: The Court held that notional income must be assessed based on established legal guidelines for minors, and that as per Mukund Dewangan, a license for smaller transport vehicles is sufficient for operating light motorcycles, maintaining insurer liability.

Result: Appeals by claimants allowed in part; appeals by Insurance Company dismissed.
